    just a bit of advice required. We have lived in USA for the last 2 years and are returning back to uk soon. I’m bringing my 2004 sn95 Mach 1 back. So is this how it works, being resident of USA for 2 years and had my Mach 1 for 1 year under the TOR transfer of residence I shouldn’t pay duty or vat as long as I have all the proof regarding living in USA and proof of ownership for the car for 1 year .

    Yep you are correct, you'll need to make a TOR application and before submitting print it off and then let us have a copy along with your application number, when you vehicle is about to arrive we can progress that free of tax and make the NOVA application for you.

      I lived in the States for 30 years and have been resident in the UK for 30 years. I have owned my Mustang for 45 years. I had all the proof supporting these facts. I still had to pay VAT when I imported the car to the UK in 2017! This was a shock because everything I had been told and researched said otherwise. However, I did not have to pay Duty.
      We never seem to have enough time to "do it right". But we always seem to have enough time to "do it again"!

        The reason for that is two fold if I understand you correctly: -

        You only have 3 years from the time of transferring your Permanent residence to either make the application or apply for it at the time of import.

        It has to be a Permanent transfer of Residence, if you owned a home in the USA for 30 years but still lived in the UK and then decide to sell your property in the US then that is not regarded as a permanent transfer of Residence.

        I always work on where did you pay you taxes as that is one of the things they check for, you have to provide bank statements as proof as well as utility bills.

        Its a little more to that but that is the gist.

        With your vehicle it probably didn't meet the criteria so you ended up paying the 5% VAT and 0% Duty under the historic regulations of 9705.

          Thanks for that... you are correct about the figures I paid. My issue will revolve around the definition of "Transfer of Residence" and the fact that that happened so long ago! I have paid my taxes here in the UK since 1988!

          We never seem to have enough time to "do it right". But we always seem to have enough time to "do it again"!
